You represent and warrant that you own or have all rights, licenses, and permissions necessary to submit Your Content and to grant the license above, and that Your Content and your use of the Service do not infringe or violate the rights of any third party or any law.

5. Third-party services

The Service integrates with third-party services, including Google (Google Drive and Google APIs) and our email provider. Your use of those services through TRAX is also subject to their respective terms and privacy policies. If you connect Google Drive, you authorize TRAX to retrieve the specific files you select so it can store copies within the Service.

6. Intellectual property

The Service, including its software, design, and branding, is owned by TRAX and its licensors and is protected by intellectual-property laws. These Terms do not grant you any right in the Service other than the limited right to use it in accordance with these Terms.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA WILL NOT BE LOST. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF IMPORTANT CONTENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAX AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. TRAX’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO TRAX FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR USD 100.

You will indemnify and hold harmless TRAX and its affiliates from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

11. Termination

You or your administrator may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if necessary to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (including Sections 3–10 and 12–13) will survive.

12. Governing law and disputes
